GALVESTON - Arguing that it should be compensated for storm damage to its building's slab, Mansions at Moses Lake L.P. has filed suit against Max Specialty Insurance Co.
In a lawsuit filed July 26 in Galveston County District Court, the Texas City senior housing community says it purchased a builder's risk insurance policy from the defendant that covered "wind or hail only, all other perils excluded."
Construction on Mansions at Moses Lake had begun prior to Hurricane Ike's landfall along the upper Texas Coast in September 2008.
Before the storm, a slab had been poured for the portion of the building and completed.
"Hurricane Ike arrived," the original petition says."As a result of the damage and disruption caused by the windstorm, it was necessary and re-pour the slab."
Mansions at Moses Lake says the damages total up to $269,800.61 and the policy is subject to a deductible of $50,000.

The case has been assigned to Galveston County 212th District Court Judge Susan Criss.
