Wreck at I-10 and 11th St. subject of suit

After a driver failed to stop behind a Hardin County woman as she sat stopped at an intersection, the woman sustained physical pain in the resulting collision, according to a recently filed complaint.

Holly Miller filed a lawsuit July 29 in Jefferson County District Court against Kathy Pierce.

Miller claims she stopped at the intersection of Interstate 10 and 11th Street in Beaumont on April 30, 2009, when Pierce failed to control her speed and crashed into her.

Because of the collision, Miller lost earnings and her earning capacity, endured mental anguish and suffered physical impairment and disfigurement, according to the complaint.

Miller blames Pierce for causing the collision, saying she negligently failed to maintain a proper lookout, failed to maintain proper control of her vehicle, failed to give appropriate attention to the operation of her vehicle and failed to control her speed, among a number of other negligent acts.

In her complaint, Miller seeks an unspecified judgment, plus interest at the legal rate, costs and other relief the court deems just.

John M. Lane of Provost and Umphrey Law Firm in Beaumont will be representing her.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
