Sleeping driver blamed for I-10 wreck

A sleeping driver caused an interstate collision in Beaumont, according to a recently filed lawsuit.

Martha and Tim Briley filed a lawsuit Aug. 2 in Jefferson County District Court against Agnes Boyd.

Martha Briley claims she drove west on Interstate 10 near Beaumont on Aug. 31, 2008, when Boyd, who also drove west on the same road, fell asleep and drifted from her lane into Briley's, causing a collision.

In their complaint, the Brileys allege Martha Briley incurred medical costs and experienced physical pain, suffering, mental anguish, physical impairment and disfigurement because of the collision.

In addition, Tim Briley lost Martha Briley's consortium, love, affection, household services and support, the complaint says.

They blame Boyd for causing the collision, saying she negligently failed to keep a proper lookout, failed to timely apply her brakes, failed to maintain control of her vehicle, failed to drive in an ordinary manner, drove inattentively, failed to take proper evasive action to avoid a collision and failed to turn to avoid striking the Brileys' vehicle.

In their complaint, the Brileys are seeking actual and special damages, plus costs, pre- and post-judgment interest and other relief to which they may be entitled.

M. Kevin Queenan of Queenan Law Firm in Arlington will be representing them.

The case has been assigned to Judge Bob Wortham, 58th District Court.
