Two years ago, Shaine Mattie was helping Troy Derouen build cabinets at his Bridge City home when he sliced his arm with a saw.

On July 29 Mattie filed suit against Derouen in Orange County District Court, claiming he should have never been told to use the saw.

Court papers show that on Aug. 13, 2008, Mattie was an invitee at Derouen's residence. While helping to build the cabinets, Derouen instructed Mattie to make a cut using a chop saw.

"However, plaintiff has no experience or training using a chop saw," the suit states. "As a result, the saw cut plaintiff's arm."

In his suit, Mattie says Derouen negligently failed "to warn him of the obvious and hidden dangers inherent ... with the subject chop saw."

Mattie is suing for past and future medical expenses, mental anguish and lost wages, plus all court costs.

He is represented by Houston attorney Andrew Seerden.

The case has been assigned to Judge Dennis Powell, 163rd Judicial District.

Case No. B-100413-c
