Driver sued over minor's injuries from collision

The parents of a minor have filed suit against the driver who they claim failed to yield the right of way and struck their vehicle.

James and Mary Taylor claim Mary Taylor was driving north in the 800 block of Stillwell Boulevard in Port Arthur on Aug. 17, 2008, with minor Benisha Chevalier in her vehicle.

Suddenly, defendant James Robertson, who was driving a vehicle owned by defendant James Hopkins east in the 1500 block of Eighth Street in Port Arthur, failed to control his speed and yield the right-of-way to Mary Taylor, crashing into her vehicle, according to the complaint filed Aug. 16 in Jefferson County District Court.

Because of the accident, both Mary Taylor and Chevalier incurred medical costs and experienced physical pain, suffering, impairment and mental anguish, the suit states.

In addition, Mary Taylor lost consortium and household services, the complaint says.

James Taylor lost his wife's affection, solace, comfort, companionship, society, services, assistance and physical relationship, he claims.

They blame Robertson for causing the collision, saying he negligently failed to keep a proper lookout, failed to turn his vehicle to the left to avoid a collision, drove too fast, failed to yield the right-of-way and failed to enter the intersection only when he could safely do so.

The Taylors are seeking a judgment within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief the court deems just.

The case has been assigned to Judge Bob Wortham, 58th District Court.
