Denton County company sued for not paying overtime wages

TYLER-An employee of a Denton County company has filed a federal lawsuit to recover unpaid wages and overtime compensation.

Chris Nath filed suit against Jet Works Air Center Management, doing business as Jet Works Air Center; Jet Works Air Center Ltd., doing business as Jet Works Air Works Air Center; Walter Wayne Cecil; Howard Arthur "Trey" Bryson III; Damon Ward; Phil Jordan; and David King on Aug. 19 in Eastern District Texas, Tyler Division.

Nath was hired by the defendants in February 2006 as a paint department supervisor and he was classified as a non-exempt employee. Under his initial contract, Nath claims he was eligible for overtime compensation at his regular hourly rate for any hours worked over 40 hours per week.

According to court records, he has worked numerous hours of documented overtime for which he was not properly paid in accordance with the Fair Labor Standards Act.

Nath states he was not compensated for work that included preparing and painting aircraft, cleaning the job site and other manual labor.

He claims he requested the defendants for overtime pay but his requests were denied.

"The plaintiff was told that he was being perceived as a 'whiner' and was told to 'go get an ice cream,'" the complaint states.

The plaintiff is seeking damages for any hours he worked for which he was not paid and for his unpaid overtime compensation, liquidated damages, attorney's fees, court costs and interest.

Nath is represented by Brian T. Cartwright of Alagood & Cartwright PC in Denton.

U.S. District Judge Michael H. Schneider is assigned to the case.
