Gulf Freeway pileup subject of lawsuit

GALVESTON - A Pasadena man alleges he was severely injured in a pileup along the Gulf Freeway last year and has filed suit against those involved.

Victor Martinez's suit against Lex Van Paxton, Letanya Walker, Freddie Chandra, Janicka Hogues, Matthew Marceau, and Johnny Lee Willett explains that on July 16, 2009, Martinez stopped for traffic in front of him near the 1300 block of the Gulf Freeway when his vehicle was struck from behind.

The suit was filed Sept. 2 in Galveston County District Court.

The plaintiff argues that defendant Van Paxton was the person who hit him and caused the chain of collisions involving the other defendants.

Each motorist whom Martinez says was in the pileup failed to control their speed, maintain a proper lookout, and take evasive action, the suit states.

The original petition insists the alleged accident left Martinez with significant bodily injuries that incapacitated him.

He seeks unspecified monetary damages.

Attorney Cristobal M. Galindo of Houston is representing the plaintiff, and Galveston County 122nd District Court Judge John Ellisor is presiding over the case.
