An electrical supply company claims a Lumberton company has refused to pay it more than $10,000 for services and materials it supplied.

Wholesale Electric Supply Co. of Houston filed a lawsuit Sept. 30 in Jefferson County District Court against Kevin's A/C and Electrical, Charles Kevin Fortenberry and Kevin Koch.

Wholesale Electric claims it delivered services and merchandise to Kevin's, but has not been paid the $10,779.78 owed.

Since then, Wholesale Electric has demanded the money owed from Kevin's, but it has refused to reimburse it, according to the complaint.

Wholesale alleges breach of contract against Kevin's.

It also names Fortenberry as a defendant, saying he guaranteed repayment of the money, but has refused to pay, the suit states.

In addition, it names Koch as a defendant because he acted as an officer of Kevin's and received construction payments for improvements on the property on which Wholesale Electric worked, but refused to forward the funds to Wholesale, the complaint says.

In addition to the money it says the defendants owe it, Wholesale Electric seeks interest at the maximum rate allowed by law, attorney's fees, costs and other relief the court deems just.

The plaintiff is represented by Daniel D. Clayton of Beaumont.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
