Auto-pedestrian crash on seawall leads to wrongful death lawsuit

GALVESTON - A one-car accident on the Galveston Seawall last year that claimed the lives of a 25-year-old Houston man, his 3-year-old stepson and another child has resulted in a lawsuit.

The relatives of Tremaine Albert and Allen Meredith are suing R.D. Mainor Enterprises Inc. and Galveston residents Orvel Speck, Michael Drager and Robert Mainor for their alleged roles in the Mother's Day 2009 wreck.

Court papers filed Oct. 6 in Galveston County District Court state that Speck, then 44, left an establishment owned and operated by R.D. Mainor Enterprises in an intoxicated state and later slammed his sports utility vehicle into Albert and the two children, who were walking on the seawall as they left a beachside Mother's Day celebration.

The suit alleges the defendants' bar staff provided alcoholic beverages to Speck, who had already been drinking.

Speck was drunk to the point he drove on the sidewalk of the Seawall prior to killing Albert and Meredith, the original petition states.

Albert, Meredith and their companion died of blunt-force trauma.

The Galveston County Daily News reported in an article two months ago that Speck did not remember leaving the bar, but recalled waking up in the hospital.

His blood alcohol level was three times the legal limit, the suit states.

The plaintiffs seek damages for pain and mental anguish, other unspecified monetary damages and a jury trial.



The plaintiffs are represented by attorney R. Gary Stephens of Richmond.

Galveston County 56th District Court Judge Lonnie Cox is presiding over the case.
