SHERMAN-Two workers file a federal lawsuit against a chicken restaurant in an effort to receive unpaid overtime compensation.
Alleging violations of the Fair Labor Standards Act, Klye Farnsworth and Randy Muldoon filed suit against Brohon Inc., doing business as Chicken Express, on Oct. 21 in the Eastern District of Texas, Sherman Division.
The men were employed by Chicken Express for several years and worked in various locations in the Sherman area, according to the lawsuit. They prepared and sold chicken products and other meal products to customers.
Farnsworth and Muldoon state that they frequently worked in excess of 40 hours per week but were not paid appropriate overtime compensation for those excessive hours.
Muldoon further argues that the defendant unlawfully deducted $1,000 from his final paycheck, without proper authorization.
The defendant is accused of violating the Fair Labor Standards Act by not paying the non-exempt employees for all hours worked in excess of 40 per week.
The plaintiffs are asking the court for an award of all overtime compensation owed, liquidated damages, attorney's fees and interest.
Farnsworth and Muldoon are represented by Durwood D. Crawford, Lindsey L. Reinhardt of Goins, Underkofler, Crawford & Langdon in Dallas.
Jury trial is requested.
U.S. District Judge Richard A. Schell is assigned to the case.
