Former Performance Contractors employee Gregory Gilreath alleges an injury he suffered while on the job went unreported so the company could reap incentives offered from Motiva.
The suit was filed Nov. 4 in Jefferson County District Court.
According to the petition, Gilreath was working at the Motiva plant when he tore his bicep. His employer, Performance Contractors, allegedly "refused to treat the injury because Motiva has an incentive payment plan for lack of job-related injuries."
The suit does not say how or when the injury occurred.
Gilreath claims the company transferred him and then retaliated by firing him when he sought worker's compensation, court papers say.
The suit accuses Performance Contractors of violating the Texas Labor Code.
Gilreath is suing for punitive and actual damages for the disregard of his rights.
He is represented by Beaumont attorney John Morgan.
The case has been assigned to Judge Donald Floyd, 172nd District Court.
