MARSHALL-A Texas woman has filed a lawsuit alleging debt collectors harassed her even though they had the wrong person.
Pamela Davis filed suit against G.E. Money Bank, G.E. Capital, Northland Group Inc., LVNV Funding and Law Offices of Brachfeld and Associates on Nov. 12 in the Eastern District of Texas, Marshall Division.
Davis claims the defendants committed various statutory and Texas common law violations, including negligence, wrongful debt collection and intentional infliction of emotional distress.
She states she notified the defendants in writing of their violation but they continued to endlessly harass her over the mistaken identity debt collection. She claims she suffered serious illness, worry, vexation and mental anguish.
The plaintiff is asking for an award of all damages allowed by law, including damage to her credit rating, interest and punitive damages.
Davis is represented by Longview attorney David Robertson. Jury trial is requested.
U.S. District Judge T. John Ward is assigned to the case.
