GALVESTON - Clifton and Helen Jones seek to recover unpaid claim compensation from Fire Insurance Exchange for reported damages they argue their Texas City home sustained during a July storm.
The Joneses filed a lawsuit Dec. 9 in Galveston County District Court, alleging they submitted a claim to Fire Insurance Exchange after their home took in water during a storm this summer. The plaintiffs allege they have not received full compensation from the insurance company.
The plaintiffs also requested Fire Insurance to cover any repair costs, the suit says.
Court papers further explain that the defendant "wrongfully denied the Jones' claim for repairs of the property even though the policy provided coverage for losses such as those suffered by the plaintiffs."
The Joneses insist they were underpaid while Fire Exchange continued to delay in the payment for the damages to the property.
"As such, the plaintiffs have not been paid in full for the damages to their home," the original petition states.
Consequently, the Joneses seek unspecified monetary damages and a jury trial.
They are represented by attorneys J. Steve Mostyn of Houston and A. Craig Eiland of Galveston.
Galveston County 10th District Court Judge David Garner is presiding over the case.
