Capital One Auto Finance sues to recover $12K debt

Hoping to recover nearly $12, 000 from a past due account, Capital One Auto Finance had filed suit against Beaumont resident Jarron Peacock and Houston resident Demetrie Holman.

The suit was filed Dec. 13 in Jefferson County District Court.

On Sept. 17 Capital One sent a letter to the defendants demanding full payment of the debt, which stands at $9,080.58, plus $2,870.69 in accrued interest, according to the complaint.

The suit does not say when the parties agreed to the loan or for what purposes.

"Plaintiff is entitled to recover on the account because transactions between (the parties) gave rise ... to the debt," the suit states. "The account is a contractual agreement under Texas law."

Capital One is suing for actual and consequential damages, plus attorney's fees.

The company is represented by Carrollton attorney Michael Scott.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
