Circle A Food Mart on Calder Avenue

Beaumont resident Cheryll Johnson is suing Circle A Food Mart for allegedly failing to post a sign warning customers of a "poorly maintained step."

The suit was filed Jan. 12 in Jefferson County District Court.

Court papers show that on Feb. 2, 2009, Johnson was exiting the Circle A Food Mart on Calder Avenue in Beaumont when "she fell due to a dangerous, poorly maintained step."

"There were no warning signs in the area," the suit states. "The fall resulted in the injuries and damages complained of herein."

The suit fails to state how the step was "dangerous" and only says the defendant owed her and the public a duty to warn them of the danger.

Johnson is suing the company for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages.

Beaumont attorney Jonathan Juhan represents her.

Judge Donald Floyd, 172nd District Court, has been assigned to the case.
