GALVESTON � Alleging his ex-girlfriend and her family defrauded him and his parents of approximately $3,000 and took his personal property without permission, a Corpus Christi man is pursing litigation, recent court documents say.
In a lawsuit filed Jan. 14 in Galveston County District Court, Eric Andre Wolfe claims that Kelly Marie Chavarria of Galveston and her parents Ralph and Kitty Chavarria removed all of his belongings from the former couple's Seabrook residence as a form of retaliation and have refused to return any of the items to this day.
Among the things the plaintiff insists the defendants are holding is his 2008 Suzuki motorcycle, which is reportedly stored in the Chavarrias' garage in Galveston.
According to the original petition, Wolfe � who moved to Corpus Christi in late 2009 to work for a law firm there � sold the property toward the end of the year after Kelly Chavarria told the complainant she would accompany him. Wolfe's parents gave them $2,600 to pay the January 2010 mortgage and utilities prior to the sale.
The suit explains that the plaintiff, however, knew Kelly Chavarria did not have any intentions to go to Corpus Christi with him so he ultimately ended the relationship in early January of last year.
On Jan. 8, 2010, the day after the break-up in question, Wolfe and his parents went to the house to find the defendants with others packing and moving contents. The plaintiff returned the following Sunday to discover the place completely empty, the suit says.
It also asserts not only did the Chavarrias take everything that was Wolfe's, but "they also adjusted the thermostat to 90 degrees and opened all of the windows of the home in an exhibition of retaliation against the plaintiff and his family."
Wolfe eventually learned that Kelly Chavarria did not use the $2,600 for its intended purposes.
"The defendant admitted to taking the money for her own use and benefit," the suit says.
Consequently, the plaintiff seeks unspecified monetary damages.
He is represented by attorney Greg Enos of Webster.
Galveston County 56th District Court Judge Lonnie Cox is presiding over the case.
