Woman claims day spa out of towels, sues after slipping

Vallie Marie Day Spa in Beaumont

Alleging she was forced to dry off with her bathrobe, Tonya Hawkins recently filed a slip-and-fall lawsuit against the Vallie Marie Day Spa in Beaumont.

The suit was filed Jan. 21 in Jefferson County District Court.

Court records show that on Oct. 7, 2009, Hawkins had an appointment at the day spa for a massage and other services. After her massage, she went to get dressed for the rest of her appointment.

"When she entered the shower area, she noticed there were no towels or bath products," the suit states.

"Hawkins used her robe to wipe off the oils and lotions used in the massage and got dressed. When she reached the steps and took her first step, she slipped and fell down the entire flight of steps, causing injury to her hip, pelvis, left femur, elbow and arm."

In her suit, Hawkins alleges the day spa negligently failed "to provide adequate safety precautions" to prevent her fall and also failed to warn of the danger.

She is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages.

Austin attorney Matthew Riley of the Moore Landrey law firm represents her.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
