Pipefitter struck by tool bag sues refinery

GALVESTON - After falling from a platform at Marathon's Texas City plant last year, Ramon Olvera of Dickinson has filed suit against Marathon Oil Co., Marathon Petroleum Co. LP and J.V. Piping Inc.

According to a lawsuit filed Jan. 26 in Galveston County District Court, Olvera claims a bag of tools fell from a platform 40 feet above him, causing him to fall backwards and injure his neck and right shoulder.

The plaintiff, who works as a pipefitter for Shaw Group Inc., was at the Marathon facilities on Jan. 13, 2010, to help with a shut-down procedure on a propylene unit. He claims a J.V. employee was responsible for dropping the bag that struck his helmet, the suit says.

It insists he "was instructed to work in this area by the Marathon defendants who had knowledge of the J.V. employees' work in the areas above and the associated hazards."

Olvera's injuries required surgery, the original petition says.

Consequently, he seeks unspecified monetary damages and a jury trial.

His employer is not a defendant in the suit.

The Crowder Law Firm is representing the plaintiff, and Galveston County 212th District Court Judge Susan Criss is presiding over the case.
