Wreck on Phelan Blvd. subject of suit

By Kelly Holleran | Feb 22, 2011

Two Beaumont residents claim they experienced extreme physical pain, suffering, mental anguish, disfigurement and physical impairment after a driver collided with them when she failed to stop at a red light.

Sharon Fontenot and Dominica Briggs filed a lawsuit Feb. 10 in Jefferson County District Court against Sharon and Jack Moody.

Fontenot and Briggs claim they were traveling in a vehicle headed east on Phelan Boulevard in Beaumont when Sharon Moody suddenly ran a red light, causing the collision.

In addition to the pain and suffering Fontenot and Briggs experienced, they incurred medical costs, according to the complaint.

They blame Sharon Moody for causing the collision, saying she negligently failed to maintain a proper lookout, failed to timely apply her brakes and disregarded a stop and go signal.

They also name Jack Moody as a defendant, blaming him for negligent entrustment.

In their complaint, Fontenot and Briggs seek an unspecified judgment, plus interest at the legal rate, costs and other relief the court deems just.

James E. Payne, Jennifer Job Seale and Ronnie Turner Jr. of Provost and Umphrey Law Firm in Beaumont will be representing them.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.

Case No. B189-347
