Woman sues Wal-Mart over fall at La Marque store while pregnant

GALVESTON � A Galveston County woman has filed a $50,000 lawsuit against Wal-Mart over a fall she took at its La Marque store more than a year ago.

Samantha Pena was pregnant and at the start of her second trimester when she slipped and fell near the store's entrance on Oct. 16, 2009. According to a lawsuit filed Feb. 24 in Galveston County Court at Law No. 2, Pena claims that she "kept a proper lookout, but she had no way of knowing that the floor was wet until it was too late."

Wal-Mart is faulted for failing to warn Pena about the dangerous condition and allowing the liquid to remain on the floor.

The alleged incident left the complainant with injuries to her left arm, left shoulder, neck, mid-upper back and lumbar area. The suit does not state if the fall affected her pregnancy or the health of the unborn child.

Attorney Gregory W. Allen of Houston is representing the plaintiff, and Galveston County Court at Law No. 2 Judge Barbara Roberts is presiding over the case.
