A Beaumont man has filed suit against the driver who he claims struck him after the driver attempted to make a right-hand turn.
Robert Benjamin Mitchell claims he was driving north in the 3300 block of Concord Road in Beaumont when defendant, Ruby Aesha Akbar, who was driving a Nissan Versa owned by defendant Hamdullah Akbar in the same direction, attempted to make a turn and struck his vehicle.
Because of the collision, which occurred on Aug. 24, Mitchell incurred cervical neck pain and lumbar back pain, according to the complaint filed Feb. 23 in Jefferson County District Court. In addition, he incurred medical costs and experienced pain, suffering and mental anguish, the suit states.
Ruby Akbar negligently failed to keep a proper lookout, failed to timely apply his brakes, failed to avoid the incident and failed to drive as a reasonable person would have done, the complaint says.
Mitchell also names Hamidullah Akbar as a defendant, blaming him for negligent entrustment.
In his complaint, Mitchell is seeking a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest at the legal rate, actual damages and other relief the court deems just.

The case has been assigned to Judge Bob Wortham, 58th District Court.
