Preferential trial setting slated in suit blaming Gulf Harvest Seafood for man's death

A June preferential trial setting has been slated in a case alleging Gulf Harvest Seafood caused a processing facility worker's death by failing to provide him with medical care after he was injured.

According to the lawsuit, filed by Sidnitra Bias on Dec. 19, 2008, Sidney Carroll Prevost Jr. died Sept. 27, 2008, while working for Gulf Harvest Seafood near the Intercoastal Canal in Port Arthur.

As previously reported, the 47-year-old Prevost hit his head at the facility and asked to be taken to the hospital. Instead, the plaintiff claims the company told Prevost to lie down in the break room.

In her suit, Bias alleges no one went to check on Prevost, and he was later found dead in the room.

"Mr. Prevost's death could have been prevented by the slightest degree of care on the part of Gulf Harvest," the suit states. "However, not only did they fail in rendering the care, they were consciously indifferent to Mr. Prevost's condition."

On Jan. 28, Judge Donald Floyd, 172nd District Court, ordered the case be preferentially set for trial on June 6.

Court records show Bias filed the motion for the preferential trial setting on Dec. 10, asserting that all discovery had been completed in the case.

Due to Prevost's death, Bias claims she suffered the loss of Prevost's care, maintenance, support, services, advice and counsel and incurred funeral costs.

Bias also claims a loss of Prevost's love, companionship, society and support and experienced mental anguish, a loss in inheritance and a loss of consortium.

Kurt B. Arnold, Michael E. Pierce and Paul Skrabanek of Arnold and Itkin in Houston will represent him.

Gulf Harvest is represented by Port Arthur attorney Brandon Monk.
