SHERMAN - A Lewisville bar is being sued for more than $170,000 on allegations it illegally unscrambled and broadcast a 2008 championship fight.
J&J Sports Productions Inc., as broadcast licensee of the March 15, 2008, "Unfinished Business: Pacquiao/Marquez Event" filed suit against El Caporal Restaurant & Bar Inc. and its owner Oscar Arias on March 15 in the Eastern District of Texas, Sherman division.
The fight between Manny Pacquiao and Manuel Marquez II was broadcast via closed-circuit only to commercial establishments which were contractually authorized. The event was electronically coded and scrambled.
The defendants are accused of willfully intercepting and receiving the interstate communication of the event. According to the lawsuit, the defendants misappropriated the exhibition showing it to patrons within their establishment.
J&J Sports is asking for an award of $170,000 in statutory damages, court costs, attorney's fees and expenses and interest. The plaintiff is also asking the court to issue a permanent injunction preventing from exhibition of unauthorized or unlicensed programs.
The plaintiff is represented by Andrew R. Korn and David M. Diaz of Korn, Bowdich & Diaz in Dallas.
U.S. District Judge Michael H. Schneider is assigned to the case.
