GALVESTON � Marie Kraft is suing a number of companies, including Shaw Industries Inc., over injuries she reportedly sustained in a fall two years ago, recent court documents say.
According to a lawsuit filed March 31 in Galveston County District Court, Kraft tripped and fell over some newly-installed carpet at her workplace on April 6, 2009.
Joining Shaw Industries is Spectra Contract Floorin and agents Matt Jozwiak and Leonardo Guajardo.
The plaintiff claims the defendants performed and completed the installation, but failed to put the phone lines and computer wires where they had been prior to replacing the carpet.
"Upon Marie Kraft's return to work, she tripped and fell on the floor due to a dangerous condition created by the defendants," the original petition says.
"As a direct and proximate cause of the incident, plaintiff Marie Kraft sustained severe injuries."
The suit faults the defendants for creating and maintaining a dangerous condition, failing to inspect the premises, failing to make corrections, failing to warn the plaintiff, failing to provide and maintain a reasonably safe place for visitors to shop and failing to properly supervise the employees.
Consequently, Kraft sues for physical pain and suffering, mental anguish, lost wages and earning capacity. She also demands a jury trial.
Bettison, Doyle, Apffel & Guarino PC is representing the plaintiff.
Galveston County 212th District Court Judge Susan Criss is presiding over the case.
