Man claims he was struck while strolling through Wal-Mart parking lot

A man claims he incurred medical costs after a driver struck him as he strolled through Wal-Mart's parking lot.

Allen O'Keefe filed a lawsuit April 8 in Jefferson County District Court against Dodson Trucking, J. Dodson Trucking and Tom Kimbrough King.

O'Keefe claims he exited the Wal-Mart Supercenter on Memorial Boulevard in Port Arthur on Oct. 16 when King, who drove a vehicle for Dodson, struck him.

Because of the accident, O'Keefe incurred medical costs; experienced physical pain, suffering and physical impairment; and lost earnings and his earning capacity, according to the complaint. He also lost consortium, lost household services, and experienced disfigurement and mental anguish, the suit states.

O'Keefe blames King for negligence and accuses Dodson of negligent entrustment and negligent hiring.

In his complaint, O'Keefe seeks a judgment within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest, costs and other relief the court deems just.

He will be represented by Derek L. Burkhalter of Burkholter and Skov in Houston.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
