GALVESTON Ã¯Â¿Â½ A Pasadena-based Pakistani journalist is asking the Galveston County 10th District Court to substitute service on another Pakistani man he claims assaulted him outside a League City bank.
Manzoor Memon filed a motion for alternate service on March 28.
Memon is suing Syed Bukhari for attacking him in the parking lot of the League City branch of Hometown Bank after a chance encounter in March 2010.
As the Southeast Texas Record previously reported, Memon filed suit last Sept. 21, claiming Bukhari beat the plaintiff in response to a news investigation on his alleged financial misconduct. The bank and the city of League City join Bukhari as defendants in the case.
According to Memon, the bank and the city did not help him resolve the situation.
Hometown Bank issued its original answer a month after Memon initiated legal action, contending the plaintiff "fails to state a cause of action against the defendant."
Memon amended his complaint in November 2010.
His request to substitute service says efforts to serve Bukhari were unsuccessful.
"The request was given to the Galveston County Sheriff's Office to serve, but the defendant continues to dodge the constables even though he has been seen in public and is available at many of his stores located in League City and the Pasadena area," court papers say.
The plaintiff is representing himself in the case.
Galveston County 10th District Court Judge David Garner is presiding over the litigation.
