A railroad worker has filed a lawsuit claiming she was subjected to a hostile work environment because of her sex and was discharged because she complained about the sexual harassment.

Claiming violations of her civil rights by gender discrimination and retaliation by termination, Denise Sellers filed suit against her employer BNSF Railway Co.

The lawsuit was filed on April 25 in the Eastern District of Texas, Beaumont Division.

Sellers states that she has been a loyal, dutiful and responsible employee but despite her performance, she was terminated due to her gender and in retaliation for her prior charge of discrimination.

The plaintiff is seeking damages for emotional distress, actual and compensatory damages for lost income, punitive damages, court costs and attorney's fees.

Sellers is represented by Jill S. Chatelain of McPherson, Hughes, Bradley, Wimberley, Steele & Chatelain in Port Arthur.

U.S. District Judge Marcia A. Crone is assigned to the case.
