TYLER - An 84-year-old handyman has filed an age discrimination lawsuit against his employer after he was terminated and replaced with a younger worker.

Claiming violations of the Age Discrimination in Employment Act, Roy Gayle Box filed suit against Silverleaf Resorts Inc. on May 5 in the Eastern District of Texas, Tyler Division.

The defendant hired Box in 2008 as a maintenance technician to work at Lake O'The Woods RV Park in Flint.

According to the plaintiff's complaint, the defendant's quality control manager came to the Lake O'The Woods location in April 2010 and informed the local manager that Box needed to be replaced because of his age.

Box was terminated in June 2010 by his manager, who stated she did not believe the termination was right, Box claims.

The plaintiff is asking the court to issue an injunction to prohibit future discrimination and for an award of back-pay, reinstatement or front-pay, liquidated damages, attorney's fees, interest and court costs.

Box is represented by Alex A. Castetter of Stuckey, Garrigan & Castetter in Nacogdoches and Tyler attorney Karen Badgley. A jury trial is requested.

U.S. District Judge Michael H. Schneider is assigned to the case.
