Local homebuilders file defamation suit against website operator

Two Jefferson County homebuilders have filed suit against the man who they claim operated a slanderous website.

Richard and Tonia Guseman, doing business as Guseman Homes, claim defendant Samuel Lawrence Guseman began operating a website, www.gusemanhomes.com, in July 2007 and ran it through May 2010.

On the website, Samuel Guseman allegedly published libelous, slanderous and defamatory information of a "personal and sexual nature," the suit states.

"This website and its contents was viewed by, among others, vendors of Guseman Homes and more likely than not home buyers and the public at large," the complaint filed May 6 in Jefferson County District Court says.

Because of the material published on the website, Richard and Tonia Guseman suffered mental anguish, according to the complaint.

Richard and Tonia Guseman allege defamation and invasion of privacy against Samuel Guseman.

They seek actual damages in excess of the minimum jurisdictional limits of Jefferson County District Court, plus exemplary damages, pre- and post-judgment interest at the maximum rate, costs and other relief the court deems just.

They will be represented by Brain D. Sutton and Stephanie H. Harris of Sutton and Jacobs in Beaumont.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
