MARSHALL - A licensed vocational nurse has filed a racial discrimination lawsuit against her employer after she lost the job she held for six months.

Deborah K. McKinley filed suit against Whispering Pines Lodge on May 10 in the Eastern District of Texas, Marshall Division.

McKinley, a black female LVN, was hired by the defendant on Jan. 15, 2010, and discharged six months later. She claims she was terminated due to her race.

Prior to her termination, she states she was treated differently from other similarly situated white employees by having different shift assignments, discipline, suspensions and terminations.

The defendant is accused of violating McKinley's civil rights through racial discrimination.

The plaintiff is seeking damages for lost pay and fringe benefits, compensatory and exemplary damages, attorney's fees and court costs.

McKinley is represented by H.N. Cunningham III and Scott A. DuLaney of Roberts, Cunningham & Stripling in Dallas. A jury trial is requested.

U.S. District Judge T. John Ward is assigned to the case.
