Tran firm files suit over BP litigation fees

GALVESTON - The Tammy Tran Law Firm alleges Aurora, Colo.-based Franklin D. Azar & Associates is engaging in actions and conduct it deems as tortuous interference in regards to Deepwater Horizon litigation, recent court documents say.

Houston attorney Tammy Tran filed suit May 17 in Galveston County District Court, accusing the Azar of trying to extract attorney's fees from Galveston County resident Dung Van Nguyen and her numerous clients though it has no connection to them.

Tran represents a number of complainants injured as a result of the April 20, 2010, oil spill. Her firm submitted many claims to BP's Gulf Coast Claims Facility and its administrator for evaluation and settlement.

The original petition shows Azar made a claim for attorney's fees from Nguyen and Tran's other clients.

"As a matter of law, Azar has no interest in any claim or recovery in any claims submitted by Tran on behalf of her clients with GCCF," the suit says.

"Azar is prohibited from making any claim or asserting any interest in any claim or recovery with GCCF."

It further explains that the defendant wrote GCCF twice in an effort to cease any payments to Tran's practice.

Consequently, the complainant seeks actual, general, special and consequential damages as well as a jury trial.

Attorney J. Marcus Hill of Houston is representing Tran and her firm while attorney Pete Mai of Houston is representing Nguyen.

The case has been assigned to Galveston County 56th District Court Judge Lonnie Cox.
