SHERMAN - A visitor to a fitness center has filed a lawsuit for more than $300,000 after she tripped and fell, hitting her knee on metal.
Adriana Brena filed suit against 24 Hour Fitness USA Inc. on March 4 in Denton County District Court. The defendant removed the case to the Eastern District of Texas, Sherman Division on May 19.
The incident occurred on June 15, 2010, as Brena was walking through the premises of a 24 Hour Fitness in Lewisville. She states she tripped and fell over loose cables that were on the ground. She fell forward, striking her knee on a piece of metal.
The defendant is accused of negligence for failing to inspect the premises on a regular basis, failing to perform needed repairs, failing to place signs warning invitees, failing to instruct or train its employees to maintain a hazard free environment and failing to supervise its employees.
The plaintiff is asking for more than $300,000 in damages for physical pain, mental anguish, medical expenses, physical impairment, interest and court costs.

U.S. District Judge Richard A. Schell is assigned to the case.
