Red light runner blamed for crash on Gulf Street

A Beaumont man has filed suit against the driver who he claims ran a red light, causing a collision.

Milton Hudson claims he was driving on Gulf Street in Beaumont on June 6, 2009, when defendant Todd Garner ran a red traffic signal, slamming into Hudson's vehicle.

Because of the collision, Hudson suffered severe neck, back, left shoulder and left arm pain and incurred medical costs, according to the complaint filed May 26 in Jefferson County District Court.

In addition, he lost his earnings and earning capacity; suffered physical impairment, physical pain and mental anguish; and incurred property costs, the suit states.

Todd Garner negligently failed to maintain control of his vehicle, failed to keep a proper lookout and failed to obey a traffic control device, the complaint says.

In addition to Todd Garner, Hudson names Colleen Garner as a defendant. Colleen Garner owned the vehicle Todd Garner drove at the time of the collision, according to the complaint.

However, Hudson claims Colleen Garner should never have loaned the vehicle to Todd Garner as he had a suspended or revoked license and had proven to be an incompetent driver who was a risk to others.

In his complaint, Hudson is seeking an unspecified judgment, plus pre-judgment interest, costs and other relief the court deems just.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
