A Hamshire man claims he incurred medical costs after a driver failed to yield the right-of-way at a flashing red light and slammed into his vehicle.
Jimmy Sparks filed a lawsuit May 5 in Jefferson County District Court against Fancy Michell and Wendy Hebert.
In his complaint, Sparks alleges he drove west on State Highway 124 when he approached its intersection with Hamshire Road on May 6, 2009. Suddenly, Fancy Hebert failed to yield the right-of-way at a flashing red light and slammed into his vehicle, according to the complaint.
Because of the collision, Sparks incurred medical costs, sustained mental anguish, physical pain, suffering and physical impairment and lost his earning capacity, the suit states. In addition, he incurred property damages, the complaint says.
Sparks blames Fancy Hebert for causing the collision, saying she negligently failed to stop at a stop light and failed to yield the right-of-way.
He also names Wendy Hebert as a defendant, saying she should never have lent her vehicle to the 16-year-old Fancy Hebert, who was an unsafe and untrained driver, according to the complaint.
In his complaint, Sparks seeks a judgment in excess of the limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief to which he may be entitled.
Clay Dugas and Mike Jacobellis of Beaumont will be representing him.
Judge Milton Shuffield, 136th District Court, has been assigned to the case.
