GALVESTON - Culwell Designs is suing Aqueduct Plumbing Co. over a component which reportedly caused a water leak at their clients' residence in Galveston last September.
Culwell's lawsuit claims Aqueduct "has failed to take responsibility for the leaking elbow joint that it sold and installed" at the home of Larry and Nancy Kitchel.
Court papers were filed June 17 in Galveston County Court at Law No. 2.
The original petition shows that Culwell, which was tasked with constructing the Kitchel house, contracted with Aqueduct in or around the fall of 2009.
The defendant installed the plumbing at the property, but in September 2010 the Kitchels discovered a leak.
They immediately notified the complainant, and an inspection was conducted.
"It was then discovered that an elbow joint in the plumbing line supplied and installed by the defendant was leaking," the suit says.
"The elbow joint was either defective when installed by the defendant or was damaged during the installation."
According to the complaint, Culwell repaired the water damage to the house in accordance to its warranty obligations.
The plaintiff estimates the work to cost approximately $3,800.
Aqueduct replaced the leaking elbow joint on the property, but failed to pay for the repairs required as a result of the water damage, the suit says.
Consequently, Culwell seeks unspecified monetary damages.
It is represented by attorney Jeffrey L. Doggett of Houston.
The case has been assigned to Galveston County Court at Law No. 2 Judge Barbara Roberts.
