Wrongful death suit filed over Galveston man's electrocution

GALVESTON � A Huntsville man has filed a wrongful death lawsuit against his late son's employer in Galveston, recent court documents say.

In a lawsuit filed June 16 in Galveston County District Court, Robert A. Hicks Sr. claims Robert A. Hicks Jr. died on Aug. 28, 2010, while on the clock for Halcumb Air Conditioning & Refrigerating Inc.

The younger Hicks was working at a residence in the 2900 block of Avenue Q 1/2 when he was electrocuted, according to the original petition.

His father claims the defendant did not maintain workers compensation insurance under the Texas Labor Code.

The plaintiff alleges Halcumb's alleged negligence contributed to his son's death. He is claiming his son's death has caused him to suffer a loss of companionship and mental anguish.

According to the suit, Hicks Jr. was not married, had no children, owned no real property and did not owe two or more debts at the time that he died, therefore making administration unnecessary, the suit says.

Hick, Sr., the community survivor of Hicks Jr.'s estate, is suing for the pain, suffering and mental anguish suffered by his son prior to his death, as well as medical and funeral expenses.

A jury trial is requested.

Attorneys Richard Schechter and David J. Salinsky of Houston are representing the plaintiff.

Galveston County 122nd District Court Judge John Ellisor is presiding over the case.
