Deed to La Marque residence leads to legal dispute

GALVESTON – Alvin Antoine alleges that Taylor Antoine refuses to hand him the deed to a residence in La Marque.

A lawsuit filed June 16 in Galveston County District Court insists that the property in the 100 block of N. Harlton Street should go to Alvin Antoine.

According to the complaint, Alvin Antoine, who is unable to read or write English, spoke to Taylor Antoine in June 1999 about buying the lot. Alvin Antoine offered to pay the mortgage while the defendant consented to turn the property over when everything is paid off, the original petition says.

Alvin Antoine had handled any expenses incurred by the house for the past 10 years.

He asked Taylor Antoine several times to give him the deed, with the defendant responding that he would as soon as he could get someone to write it for him, the suit states.

Taylor Antoine filed a forcible detainer suit in a local court last year in response to Alvin Antoine's alleged rent delinquency, but the case was dismissed because a landlord-tenant relationship was not established.

The plaintiff says his efforts to acquire the deed are unsuccessful as the defendant refuses to convey the property to him.

Attorney Robert L. Penrice of La Marque is representing Alvin Antoine, and Galveston County 10th District Court Judge David Garner is presiding over the case.
