Contract worker sues to obtain wages for unpaid travel time

A contract worker has filed a collective lawsuit in an attempt to obtain wages for time spent traveling to the Motiva facility in Port Arthur.

Claiming violations of the Fair Labor Standards Act, Samuel T. McCarty filed suit against I.S.C. Constructors on June 30 in the Eastern District of Texas, Beaumont Division.

McCarty states the defendant violated federal law by not compensating its employees for their travel time to the Motiva facility. According to the lawsuit, the employees were required to report for work at a certain location and time and then they would be transported on a bus to the Motiva facility. Each day, the time spent in transit was at least 30 minutes.

The plaintiff is asking the court for an award of damages for unpaid wages, liquidated damages, attorney's fees, interest and court costs.

McCarty is represented by John Werner of Reaud, Morgan & Quinn in Beaumont.

U.S. District Judge Ron Clark is assigned to the case.
