Store sued for showing disregard for safety of customers

MARSHALL - An Oklahoma resident has filed a lawsuit against Wal-Mart claiming the store showed a total disregard for the safety of its customers and failed to correct a dangerous situation in one of its East Texas stores.

Claiming personal injuries, Billie Monroe filed suit against Wal-Mart Stores Texas on July 21 in the Eastern District of Texas, Marshall Division.

According to the lawsuit, an accident occurred on Aug. 1, 2009, as Billie Monroe was shopping at the Wal-Mart in Paris, Texas. She states she fell to the floor near the dairy case and sustained permanently disabling injuries.

The defendant is accused of negligence for failing to use ordinary care to correct the dangerous condition and to warn Monroe of its presence. Wal-Mart is also accused of gross negligence for showing a total disregard for the "substantial likelihood of serious injury" and for a "total want of due care for the safety of others."

The plaintiff is seeking damages for medical expenses, permanent disfigurement, physical impairment and pain, suffering, mental anguish, lost wages and loss of earning capacity.

Monroe is represented by Mark P. McMahon of Erskine & McMahon in Longview. A jury trial is requested.

U.S. District Judge T. John Ward Jr. is assigned to the case.
