GALVESTON - Maria Theresa Guidry is suing Monte James Guidry over a credit card debt, recent court documents say.
A lawsuit filed July 21 in Galveston County District Court states that Monte James Guidry failed to make payments on a Bank of America Visa credit card since May 9, 2010, and currently owes the plaintiff $71,103.27.
The parties in the suit have been divorced since late 2009.
According to the original petition, as a major term of the divorce, the respondent became bound and liable to pay a debt owed to BoA for the Visa credit card and to make all reasonable efforts to remove Maria Theresa Guidry from the account.
"Mr. Guidry agreed to timely make all payments due on the Bank of America Visa credit card and to indemnify Maria Guidry for any and all payments due on the credit card," the suit says.
It adds Monte James Guidry made, executed and delivered to Maria Theresa Guidry a real estate lien note dated May 21, 2010, in the original principal amount of $50,200 on some property in Galveston.
Maria Theresa Guidry argues, however, that her former spouse did not perform his contractual obligations, saying she has made payments in the amount of $3,634.
The plaintiff believes the defendant "will fail to make any future payments."
Murray Lobb PLLC is representing the complainant, and Galveston County 10th District Court Judge David Garner is presiding over the case.
