GALVESTON - Fort Apache Energy Inc. seeks to recover more than $80,000 in connection to mineral property in Galveston County from Katy Longbow Partners LLC.

A lawsuit filed July 29 in Galveston County District Court alleges the defendant has an outstanding debt in the amount of $84,449.56 owed to Fort Apache.

Recent court documents show both parties have a joint operating agreement pertaining to the Ortego No. 1 Well in the Alta Loma field.

Fort Apache is the operator while the defendant is a working-interest owner in the well.

Their agreement, which dates back to Oct. 1, 2008, states that the defendant is responsible for paying its proportionate share of the costs of developing and operating the aforementioned well to the complainant.

Fort Apache insists it had not received any money as of last June 30.

"Despite numerous reminders and demands for payment, the defendant failed to tender the just amount owed to Fort Apache," the suit says.

The complainant claims the respondent "ignored the demand and refuses to pay the amount owed" and summarily blames its partner for breach of contract.

Attorney Richard W. Bass of Houston is representing Fort Apache, and Galveston County 56th District Court Judge Lonnie Cox is presiding over the case.
