GALVESTON - League City residents Juan Carlos Sandoval and Lizette Chacon allege Lonnie and Laurie Bennett of Keller failed to make repairs to an air conditioning unit at their residence.
A lawsuit filed Aug. 12 in Galveston County District Court states Sandoval and Chacon purchased the property in the 600 block of Constellation Boulevard, from the Bennetts at the beginning of the year. The suit states they were promised that the Bennetts would complete any repairs, notably those to the second floor air conditioner.
The Bennetts hired a heating, ventilation and air conditioning professional to fix the unit, which the plaintiffs apparently found to be working properly shortly afterwards.
The house then closed and the sale transaction was completed.
However, according to the original petition, when Sandoval and Chacon moved in they discovered there were problems with the home's air conditioner.
"While the condenser unit seemed to be operating, it would not pump cold air into the house," the suit says.
The plaintiffs immediately contacted the repairman retained by the Bennetts to conduct an inspection, which revealed a coolant leak outside.
He informed them that the repairs would cost between $3,400 and $5,400, the suit says.
The plaintiffs attempted to have the Bennetts repair the A/C, but claim the Bennetts refused. Sandoval and Chacon state they were forced to hire another professional to install a new condenser unit at a cost of $3,225.
They are requesting a trial by jury.
