Man claims Performance Contractors fired him for reporting injury

Area resident Phillip Derouen has filed suit against his former employer, Performance Contractors, for allegedly firing him after he reported an on-the-job injury.

The suit was filed Aug. 19 in Jefferson County District Court.

According to the lawsuit, on Aug. 20, 2010, Derouen allegedly suffered an injury during the course and scope of his employment with Performance.

He went home that evening and then decided to seek medical attention. The following day, he reported the injury to his supervisor and the safety department with the intent to collect worker's compensation, the suit states.

However, Derouen says in his suit he was fired immediately after reporting the injury.

Derouen maintains Performance was "motivated by ill will, spite and evil," the suit states.

The plaintiff is suing for exemplary damages.

Kenneth Lewis, attorney for the Beaumont law firm Bush Lewis, represents him.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
