TEXARKANA - A Mt. Pleasant woman is suing a local tractor supply store after she claims an employee caused her to lose her balance and fall.
A. Fay Hoffman, and her husband, A.J., filed suit against Tractor Supply Co. on April 12 in Titus County District Court. The defendant removed the case to the Eastern District of Texas, Texarkana on Aug. 23.
The incident occurred on April 16, 2009, as Hoffman was shopping at the Tractor Supply located in Mt. Pleasant. According to the plaintiffs' original complaint, an employee lifted a taped extension cord from the floor which caused Hoffman to lose her balance. She fell and suffered severe injuries to her left arm and shoulder, which later required surgery, the suit states.
The defendant is accused of negligence for failing to provide a safe customer environment, failing to make sure the area was clear of customers before lifting the extension cord and failing to warn the customers about the taped extension cord.
Hoffman is seeking damages for medical expenses, pain and suffering, mental anguish, loss of wages, loss of wage earning capacity, loss of consortium, interest and court costs.
The plaintiffs are represented by M. Mark Lesher of Lesher & Associates in Mt. Pleasant.
U.S. District Judge David Folsom is assigned to the case.
