Longshoremen sue over injuries from falling beam

After suffering severe neck injuries from a falling beam, two longshoremen have filed a lawsuit against their employer for failing to provide a safe place to work and adequate equipment.

Andrew Ramirez and Julias Mathias filed suit against Gearbulk & SSA Gulf Inc. on Aug. 31 in the Eastern District of Texas, Beaumont Division.

While performing stevedoring services aboard the Falcon Arrow owned by Gearbulk on July 14, 2010, Ramirez and Mathias claim they were injured when a beam was dropped on them.

The defendants are accused of negligence for failing to provide a safe place to work, failing to adequately provide for the removal of debris from the work premises, failing to employ proper guidelines and procedures to ensure safety of persons working on its premises, failing to provide adequate equipment or personnel to safely perform work and various acts or omissions of negligence.

Ramirez and Mathias is seeking damages for medical expenses, physical pain, suffering, mental anguish, physical disfigurement, physical impairment, physical disfigurement, loss of wages and earning capacity, interest and court costs.

The plaintiffs are represented by Jane S. Leger of Provost Umphrey Law Firm in Beaumont. A jury trial is requested.

U.S. District Judge Marcia A. Crone is assigned to the case.
