GALVESTON - Galveston County residents James and Simona Jamail have filed suit against League City local Cary R. Chapman over defects to the roof of their Friendswood residence.

Chapman, doing business as Professional Roofing Systems, negligently installed several areas of the plaintiffs' roof such that it allowed water to intrude through multiple points directly into the home's wall cavity, a lawsuit filed Oct. 5 in Galveston County District Court alleges.

According to the original petition, the plaintiffs began construction on the subject house in 2005, acting as their own contractor.

They subsequently hired the defendant to install the tile roof.

Court papers show the Jamails learned of the alleged defects on Nov. 22, 2010, "when the color of their mortar discolored due to the water entry allowed by the defendant's negligent work."

"Only after removing portions of the wall covering did the Jamails learn that Chapman had improperly terminated the sidewall flashing and counterflashing at the intersection of the roof with the rear face of the plaintiffs' parapet wall in multiple locations," the suit says.

It further claims the defendant also failed to properly seal all intersections of the roof with the home's walls, adding severe water intrusion gave way to substantial mold growth.

The complainants say they notified the respondent about their discovery, but he "has failed to recognize or correct his defective construction."

"Specifically, the plaintiffs have had to completely replace the roof the defendant installed, along with several areas of framing, interior insulation, drywall, roof flashing and roof sealant," the original petition says.

"Due to these repairs, the plaintiffs were forced to temporarily leave their home and incurred substantial costs and mental anguish because of the move."

The Jamails consequently seek unspecified monetary damages.

They are represented by Martin, Disiere, Jefferson & Wisdom.

Galveston County 122nd District Court Judge John Ellisor is presiding over the case.
