Silsbee man sues over multi-car collision

A Silsbee man says a multi-car collision caused him to sustain severe neck, mid- and lower-back, right shoulder and left hip pain.

Danny Hess filed a lawsuit Sept. 30 in Jefferson County District Court against Daryl Lemeux, Dan's Mobile Home Service, Terrence Yarbrough and Gail Yarbrough.

In his complaint, Hess alleges he rode in a vehicle Jerry Browley was driving on Eastex Freeway in Beaumont on Nov. 5, 2009, when Browley encountered stopped traffic. Daryl Lemeux, who drove a vehicle for Dan's Mobile Home Service, had caused the sudden traffic cessation, according to the complaint.

After Browley stopped for Lemeux, Terrence Yarbrough, who drove a vehicle owned by Gail Yarbrough, failed to control his speed and slammed into the back of the vehicle stopped behind Browley. In turn, that vehicle rear-ended Browley's, the suit states.

In addition to his injuries, Hess incurred medical costs, lost his earnings and his earning capacity and sustained physical impairment, physical pain and mental anguish because of the collision, the complaint says.

Hess seeks an unspecified judgment, plus interest, costs and other relief the court deems just.

Jonathan C. Juhan and J.J. Bragg of Beaumont will be representing him.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.
