Sutherland Lumber has reached a $9,940 settlement with Connie and Edward Stunkard, who sued alleging the company was responsible for their son falling out of a shopping cart.
As previously reported, the suit was filed the suit Nov. 12, 2010, in Jefferson County District Court.
On April 28 a final judgment was entered in the case, in which Sutherland agreed to pay the plaintiffs $9,940.60.
According to the suit, on Feb. 19, 2009, the minor child was in a shopping cart at the lumber store when he "fell from the cart and sustained injuries."
The suit did not state how the child fell from the cart or if the parents were supervising him at the time of the incident. The suit also declined to list a single act of negligence on Sutherland's part.
The Stunkards were originally seeking to recover a judgment of more than $75,000.
