Suit claims woman in scooter not secured during transport

A suit has been filed against the driver of a vehicle who allegedly failed to securely strap a woman in, causing her to fall to the floor during a turn.

Elizabeth Lachney filed suit on behalf of Beverly Ann Cory against A&A Transportation on Sept. 29 in Jefferson County District Court.

According to the complaint, Cory was riding in a vehicle owned by defendant A&A on Oct. 5, 2009. The driver of the A&A vehicle allegedly failed to secure Cory in her motorized scooter, according to the complaint filed Sept. 29 in Jefferson County District Court.

"As the van rounded a corner, Decedent slid from her seat and slammed to the floor of the van," the suit states.

Because of the collision, Cory suffered a medical plateau fracture, proximal phalanx fractures of her ring and pinky fingers and a deformity of her long finger, the complaint says. Because of her injuries, Lachney claims Cory incurred medical costs, lost earnings and her earning capacity and sustained physical impairment, physical pain and mental anguish.

Lachney blames A&A Transportation and its owners, Stephanie D. Asberry and Willie Lee Asbury Jr., of negligence.

In her complaint, Lachney is seeking an unspecified judgment, plus pre-judgment interest, costs and other relief the court deems just.

She will be represented by Jonathan C. Juhan and J.J. Bragg of Beaumont.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
