Company says lawyer interfered with retail property sale

A lawsuit alleges attorney David Dang interfered with a property sale.

GALVESTON - Jetall Companies Inc. alleges Four Seasons Food Distributors Inc. and Houston attorney David G. Dang kept it out of a closing on a Galveston retail center.

A lawsuit filed Oct. 10 in Galveston County District Court asserts Four Seasons breached its contract with Jetall while Dang "interfered with the assignment" in connection to the property on the city's East End.

Recent court documents explain that the plaintiff and Four Seasons entered into an agreement to which the latter agreed to assign its right to purchase a 53,761-square foot retail center located in the 500 block of Seawall Boulevard.

"As part of the consideration, the plaintiff agreed to close the transaction and was to repay Four Seasons' earnest money from the closing," the suit says.

It shows the complainant "began (its) due diligence and financial analysis of the subject property" and "also began developing and promoting the retail center to attract potential tenants."

Jetall states Dang impeded the closing process for it when he "specifically informed the title company and/or seller to exclude the plaintiff from any participation in the closing."

"Defendant David Dang is liable to the plaintiff for tortious interference with the contractual agreement between the plaintiff and co-defendant Four Seasons," the original petition says.

"Defendant Dang's conduct was intentional and aimed at causing the plaintiff financial injury."

Consequently, Jetall seeks unspecified monetary damages and a jury trial.

Michael P. Fleming & Associates is representing the plaintiff, and Galveston County 212th District Court Judge Susan Criss is presiding over the case.
